    The definition of robbery is an individual taking something from another individual or group of people by violence or the threat of violence. Thousands of individuals are convicted of robbery every year in Illinois, and robbery charges can vary depending upon if violent force or verbal threats were used during the robbery, if a weapon was used during the robbery or if the accused invaded the home of another individual during the robbery.

    The penalties for robbery can be severe. Robbery is a Class 2 felony and typically carries a three-seven year prison sentence if an individual is convicted. Robbery charges will be elevated to a Class 1 felony, which is punishable by 4-15 years, if the act was committed in a place of worship or a school, or if an individual committed the act against a handicapped individual or an individual over the age of 60.

    A charge of aggravated robbery will be issued if an individual takes another individual's property through the use of force or by threatening an individual with force by indicating they are armed with a firearm or another dangerous weapon. A crime is still considered aggravated robbery even when an individual is not in fact armed but has indicated otherwise, as exemplified by someone pointing a toy gun and threatening to shoot the other person while taking money from them. Conviction of an aggravated robbery charge is punishable by 4-15 years in prison.

    A charge of armed robbery is issued when an individual carries a dangerous weapon to take another person's property or discharges the dangerous weapon during the robbery and causes great bodily harm, permanent disfigurement or death to another individual. Penalties for armed robbery are severe, and the punishment for armed robbery can carry a 6-30 year prison sentence. However, if an individual is severely injured or killed during the robbery and the accused individual is convicted, the prison term could be up to 60 years.
